These Terms and Conditions govern your access to and use of the CheqFit website (cheqfit.com) and CheqFit mobile applications, together the Platform, operated by Cheqfit Private Limited, a company incorporated under the Companies Act, 2013, bearing Corporate Identification Number (CIN) U63112UW2026PTC253629, with its registered office at D-35, Krishna Garden, Harsaon, Kavi Nagar, Ghaziabad - 201002, Uttar Pradesh, India. This is an electronic record under the Information Technology Act, 2000, and does not require a physical or digital signature. By accessing or using the Platform in any manner, including merely browsing, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.
CheqFit is a technology platform that helps you discover, compare, and get in touch with gyms, fitness centres, and wellness facilities listed on the Platform. Through the Platform, you can browse and compare Gym Partners by category, tier, location, and amenities; submit an enquiry to a specific Gym Partner through Enquiry Now; access general fitness, nutrition, and wellness articles; and use diet and workout recommendation tools. CheqFit is a marketplace and discovery platform. We do not own, operate, or manage any Gym Partner premises, staff, or equipment. We do not sell gym memberships, and we do not process, collect, or facilitate any payment between you and a Gym Partner. Any membership, trial, or service you purchase is a transaction directly between you and the Gym Partner, on terms set entirely by that Gym Partner.
You must be at least 18 years of age and capable of entering into a binding contract under Indian law to create an account or submit an Enquiry on the Platform. If you are under 18, you may browse informational content, but a parent or guardian must complete any Enquiry or registration on your behalf.
To use certain features, you may need to register using your mobile number, verified by OTP. No separate password is required. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of access to your account and for all activity that occurs under it. Notify us immediately of any unauthorised use. You may not maintain more than one account or transfer your account to another person.
When you submit an Enquiry about a Gym Partner, we share your name, contact number, email address, and gender with that Gym Partner so they can respond to you. We do not guarantee that a Gym Partner will respond within any particular time, or at all. Pricing, offers, trial passes, and membership terms displayed on the Platform are indicative and set by the Gym Partner; CheqFit does not guarantee their accuracy or availability. CheqFit does not vet, audit, or certify the safety, hygiene, staff qualifications, or service quality of any Gym Partner beyond the Tier/Category classification assigned through our own rating criteria, which is not a guarantee of any particular standard.
The health feed and any diet or workout plan generated through the Platform are produced using general fitness formulas and standard content, and are intended for general informational purposes only. This content does not constitute medical, dietary, or fitness advice from a qualified professional. Always consult a doctor or qualified professional before beginning any fitness or diet programme, particularly if you have a pre-existing medical condition. Physical exercise carries inherent risk of injury. You confirm that you rely on any Platform information or recommendation voluntarily and at your own risk. CheqFit is not responsible for any injury, health complication, or loss arising from your reliance on Platform content or from your use of any Gym Partner facility.
You agree not to provide false, misleading, or fraudulent information; use the Platform for any unlawful purpose or to harass, defame, or impersonate any person or Gym Partner; scrape, deep-link, reverse-engineer, or use automated tools to access or extract data; attempt to gain unauthorised access to the Platform, accounts, or CheqFit systems; upload or transmit viruses, malicious code, or content that violates applicable law; or copy, reproduce, or commercially exploit any Platform content without written permission. We reserve the right to suspend or terminate access if we reasonably believe you have violated these Terms.
All content on the Platform, including the CheqFit name and logo, the Tier/Category system, health feed articles, design, source code, and diet/workout recommendation engine, is owned by CheqFit or its licensors and protected under applicable intellectual property law. You may access this content for personal, non-commercial use only. Nothing in these Terms transfers any ownership rights to you.
Certain features on the Platform, including diet and workout recommendations, use automated logic to generate suggestions based on the information you provide. These outputs are automated, may not always be accurate or complete, and do not constitute professional advice of any kind. You should independently verify and use your own judgement, and consult a qualified professional where relevant, before relying on any such output.
The Platform may link to Gym Partner websites, social media, or other third-party sites. We are not responsible for the content, practices, or policies of any third party. Your use of, or visit to, any Gym Partner premises is governed by that Gym Partner's own terms, house rules, and policies, not by these Terms.
The Platform and its content are provided as is and as available, without warranties of any kind, express or implied, including as to accuracy, completeness, merchantability, or fitness for a particular purpose. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any Gym Partner information is accurate or current.
To the maximum extent permitted by law, CheqFit shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform, your Enquiry, or your dealings with any Gym Partner. CheqFit's total liability arising out of these Terms shall not exceed Rs. 10,000 or the amount, if any, you have paid to CheqFit directly in the preceding 3 months, whichever applies.
You agree to indemnify and hold harmless CheqFit, its officers, directors, and employees from any claim arising out of your breach of these Terms, your misuse of the Platform, or your interactions with any Gym Partner.
We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may stop using the Platform, or request deletion of your account, at any time. Please see our Privacy Policy for how to do this.
These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved amicably between the parties within 15 days of written notice. Failing that, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, seated at Ghaziabad, Uttar Pradesh, and conducted in English. Subject to the foregoing, the courts at Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction.
By using the Platform, you consent to receive communications from CheqFit by SMS, WhatsApp, email, and phone call relating to your Enquiries, account, and Platform updates, even if your number is registered under DND / NCPR. You may opt out of marketing communications at any time as explained in our Privacy Policy; this will not affect service-related messages such as Enquiry confirmations.

Response time: within 15 days of receipt, or such shorter period as required by applicable law.
We may update these Terms at any time; continued use of the Platform after changes constitutes your acceptance. We will update the Effective Date for any revision. You may not assign your rights under these Terms, while CheqFit may assign these Terms to an affiliate or successor without your consent. If any provision is found unenforceable, the remaining provisions continue in full force. No failure to enforce any provision constitutes a waiver of it. These Terms, together with our Privacy Policy and, for Gym Partners, the applicable Gym Partner Onboarding and Services Agreement, constitute the entire agreement between you and CheqFit regarding the Platform.
